This license agreement covers the use of our fonts by individuals and organizations for commercial or personal purposes.

Can I put this single font on all my devices?

The number of devices allowed to install and use the purchased Font Software is equal to the quantity selected at the time of purchase. Example: If you’d like to use the Font Software on two desktops, you’ll need to purchase the Font Software twice.

So where can I use the fonts?

Usage for fonts from Dingbats Design Cave LLC includes: print publications (posters, flyers), social media content, print and digital advertising, personal art projects, audio packaging in physical and digital forms, direct to consumer physical products (apparel, product packaging, prints, greeting cards, posters up to 100,000 units), Content and titles for broadcast, film and streaming services (up to 500,000 lifetime views), Video advertising (up to 500,000 lifetime views).

When do I need to purchase an extended license?

Branding and logo creation, global or international advertising campaigns, or any use exceeding the limits described in the section above. Contact Us for extended license offerings.

What’s prohibited?

Offering our Font Software through create-on-demand software or services, letterform products, linking or embedding Font Software on websites, applications or electronic devices, and trademarked logos.

Please read this agreement carefully. We recommend that you print this End User License Agreement for further reference.

End User License Agreement (EULA) between you (the “Licensee”) and Dingbats Design Cave, LLC (the “Licensor”). By receiving, purchasing, downloading, installing, using, or otherwise handling our Font Software, you confirm that you have read, understand and agree to be bound to the terms of this EULA. If you are entering into this agreement on behalf of your employer, or your client, then “you” refers to that entity. If not, then this agreement binds you personally. This agreement does not create third party beneficiary rights for any parties. If you do not agree to the terms of this agreement, do not install the Font Software.

1. Definitions

“Font Software” means the font software identified on your Order Confirmation and the typeface designs rendered by that font software when used on an appropriate device, including but not limited to all bitmap representations of the typeface designs. Font Software also includes any related data and documentation, and any upgrades or updates Dingbats Design Cave LLC may provide to you in the future.

2. Grant of License

Upon payment in full of the non-refundable license fee, Dingbats Design Cave LLC grants you a non-exclusive, non-transferable, revocable license to use the Font Software, subject to all of the terms and conditions of this Agreement. You are granted only the rights expressly stated in this Agreement, and use of the Font Software in any other manner is strictly prohibited.

3. Permitted Uses

This Agreement permits both commercial and non-commercial use.

Commercial use is any use: (a) that involves an exchange of money or other consideration, (b) the promotes a business, product, or service, or (c) where financial gain or other consideration is either sought or a result, directly or indirectly, of Licensee’s use of the Font Software.

Non-commercial use is a use for solely personal purposes; any use that meets the definition of “commercial use” can not be a Non-commercial use.

This License permits you to use the Font Software in the following ways:

3.1 You May Install the Font Software on the Permitted Number of Computers

Use of the Font Software is limited to the number of desktop users selected at the time of purchase and displayed on your receipt.

You must purchase a license for each user who will use the Font Software. Companies purchasing multiple licenses for employees must use the Font Software subject to the terms of this agreement. You must notify all employees who will use the Font Software of the terms and conditions of this Agreement. You are responsible for any misuse of the Font Software by your employees.

So where can I use the fonts?

When do I need to purchase an extended license?

3.2 Physical Product Packaging

You may use the Font Software to create physical end-products for free or for sale including but not limited to: apparel, stickers, mugs, signs posters up to a combined limit of 100,000 units.

3.3 Digital Product Packaging

You may use the Font Software to create unlimited digital packaging including but not limited to: digital book covers, podcast covers, audiobook covers and music album covers.

3.4 Print and Digital Advertising

You may use the Font Software to create print or digital including but not limited to: billboards, signage or any printed advertisements for commercial use within a single nation/country. Digital advertising can be served by Google Ads, Bing Ads, Facebook Ads, etc.

3.5 Social Media

You may use the Font Software to create unlimited content personal, Licensee owned and/or client-owned social media accounts

3.6 Video Advertisements

You may use the Font Software to create titles or content for Broadcast, cable, streaming services, satellite, pay-per-view, view on demand or digital billboard allowed up to a limit of 500,000 lifetime views.

4. Prohibited Uses

4.1 Resale, Distribution or Sub-licensing

Except as expressly provided in this Agreement, you may not distribute, share, lend, sell, sublicense, rent, give away or otherwise transfer the Font Software to any third party (including but not limited to any client, contractor, freelancer, advertising agency, parent company, subsidiary, affiliate, or publication owned by the same parent company). You further agree to use reasonable efforts to safeguard the Font Software from unauthorized access, use, duplication or distribution.

4.2 Modifications to the Font Software

Under no circumstances may you, nor may you cause any third party to, modify, alter, translate, convert or otherwise change the Font Software in any manner whatsoever, including converting the Font Software into a different font format. You further agree not to, nor cause any third party to, reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Font Software.

4.3 Derivative Works

Under no circumstances may you, nor may you cause any third party to, create any customization, variant, adaptation or derivative work of the Font Software, or use the Font Software in connection with any font creation or font manipulation program for the purposes of creating a derivative or substitute version of the Font Software. You further agree not to create, nor cause any third party to create, any font software that incorporates or is based upon the typeface designs rendered by the Font Software. Any derivative works made in contravention of this Agreement shall be the sole and exclusive property of Dingbats Design Cave LLC and subject to the terms and conditions of this License.

4.4 Altering Name and Removal of Notices

You may not change the name of the Font Software, nor may you remove, alter or cover any copyright notice, trademark or other proprietary rights notice that Dingbats Design Cave LLC includes on, in or with the Font Software, including on any back-up copy that you are permitted to make under this Agreement.

4.5 Embedding in or inclusion with editable templates

Whether distributed for free or for sale is prohibited. This includes but is not limited to downloadable or installable website templates, presentation templates, logo-templates, social media image templates and word-processing templates.

4.6 Falsely representing authorship

Falsely representing and/or ownership of the Font Software is strictly prohibited.

4.7 Use in future technologies

Any technologies not yet in existence but can apply to usage of the Font Software are excluded from the scope of this License.

4.8 Illegal, threatening, defamatory or fraudulent material

Material intended to cause physical or mental injury, Material that promotes racism, bigotry, hatred or physical harm to racial, sexual, religious or ethnic minority groups or individuals; Material intended to cause damage to any person or property; Material that seeks to harm or exploit children by exposing them to inappropriate content; Material that may constitute or contribute to a crime; Material containing information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, harassing, humiliating to other people (publicly or otherwise), libelous, threatening or otherwise objectionable are all prohibited.

4.9 Create-On-Demand services

Any use that allows anyone other than the Licensee to customize made-to-order physical end products using the Font Software is prohibited. This includes, but is not limited to, "print-on-demand", "made-to order", "download-on-demand" and "design-it-yourself" applications and services.

4.10 Embedding in Mobile Applications, Other Software or Hardware

You may not embed or otherwise incorporate the Font Software in software or hardware in any form. This includes, but is not limited to, mobile applications, electronic games, e-book readers, smart phones, electronic kiosks, gaming devices, navigation systems and other OEM products or software. If you wish to use the Font Software for such purposes, a separate license must be obtained from Dingbats Design Cave LLC for an additional fee.

4.11 Logos & Branding

Where the Font Software is used to create a logo, the typeface design cannot be included as part of any trademark, service mark or design mark registration and must be disclaimed in any such registration. Additional licensing must be obtained from Licensor to grant usage with a trademark logo or commercial branding for a company or individual.

4.12 Any other use that is not expressly permitted in this EULA is strictly prohibited.

5. Ownership of the Font Software

You acknowledge and agree that the Font Software and the typeface designs rendered by the Font Software are the exclusive property of Dingbats Design Cave LLC and/or its designer. You further acknowledge and agree that the structure, organization and code of the Font Software are valuable trade secrets and confidential information of the owner.

This License grants you certain limited rights to use the Font Software only; it does not grant you any permanent or ownership rights in or to the Font Software or the typeface designs rendered by the Font Software. The Font Software is protected by copyright and other intellectual property laws of the United States, the country of the owner of the Font Software and other international treaties. The owner of the Font Software retains all worldwide right, title and interest in and to the Font Software and the typeface designs rendered by the Font Software, including all copyright, patent, trademark, trade secret and other intellectual property rights.

6. Restrictions on Transfer of Your License

You may not transfer or assign any of your rights under this License to any other person or legal entity without the prior written consent of Dingbats Design Cave LLC.

7. Backup Font Software

You may install the Font Software on a single file server for use on a local area network, only when the number of computers that can access the Font Software does not exceed the number of computers specified on your Order Confirmation. Installation of the Font Software on any server that can be accessed via the Internet or other external network system is strictly prohibited.

8. Termination of Your License

This License is effective until terminated. Dingbats Design Cave LLC has the right to terminate your License immediately and without notice if you breach any of the terms of this Agreement. Dingbats Design Cave LLC expressly reserves the right to seek any and all remedies under law or equity, including but not limited to injunctive relief without the obligation of posting security or bond. Upon termination, you must immediately discontinue using and delete the Font Software and documentation, including any copies, and certify that no copy remains in your possession or control.

9. Disclaimer of Warranties and Limitation of Liability

The Font Software is provided to you on an “as is” basis. Dingbats Design Cave LLC makes no representations or warranties, express or implied, about the Font Software, including but not limited to the implied warranties of merchantability, fitness for any particular purpose or non-infringement. Dingbats Design Cave LLC does not warrant that the operation of the Font Software will be unimpeded, uninterrupted or error-free, or that the Font Software is without defects. In no event shall Dingbats Design Cave LLC be liable to you or any other party for any consequential, incidental or special damages, including but not limited to any lost profits, lost data, lost business opportunities or lost savings, even if notified in advance of the possibility of such damages. In no event shall the total liability of Dingbats Design Cave LLC to you exceed the amount of the license fee paid by you under this Agreement.

Some states or jurisdictions do not allow the exclusion of implied warranties or the exclusion or limitation of liability for consequential, incidental or special damages, so the above exclusions may not apply to you. You may also have other rights that vary depending on your state or jurisdiction. The Font Software is non-returnable and non-refundable.

9.1 Indemnification

You agree to defend, indemnify and hold Dingbats Design Cave LLC, including any designers of the Font Software harmless from and against any losses, damages, expenses, and costs, including reasonable attorneys' fees, from any claim by a third party arising from or related to your breach of this Agreement or your act, error, or omission.

9.2 General

You acknowledge that you have read this Agreement and understand it and that by using the Font Software, you will be bound by its terms and conditions. No variation of the terms of this Agreement or any different terms will be enforceable against Dingbats Design Cave LLC unless without its express written consent. In the event any collection or enforcement effort or any legal action is instituted by Dingbats Design Cave LLC to interpret or enforce this Agreement, you will be responsible for paying reasonable attorneys' fees incurred by Dingbats Design Cave LLC. Dingbats Design Cave LLC expressly reserves the right to amend or modify this Agreement at any time and without prior notification.
